Welcome to Oonagh AI. These Terms of Service ("Terms") govern your access to and use of the Oonagh AI platform, including our website, applications, APIs, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
Oonagh AI ("we," "us," or "our") is a clinical documentation platform designed specifically for Licensed Acupuncturists, UK-based Medical Acupuncturists, Registered Osteopaths, Canadian Osteopathic Manual Therapists, and integrative medicine professionals.
Eligibility and Registration
Professional Requirements
The Service is available only to licensed or certified healthcare practitioners. By registering for the Service, you represent and warrant that you meet the professional requirements of your practicing jurisdiction.
Due to differing international regulations, the following specific requirements apply:
For Practitioners in the United Kingdom:
- TCM Acupuncturists: Must provide evidence of either (a) a three-year accredited degree in acupuncture or (b) a two-year Master's degree in Acupuncture. In both cases, practitioners must hold current registration with a relevant professional council.
- Other Regulated Healthcare Professionals (e.g., Osteopaths, Chiropractors, Physiotherapists, Nurses, and Physicians): Must provide evidence of holding a Certificate or Certificate of Competence in medical acupuncture.
We may ask for proof of qualifications as part of our quality audit process.
For Practitioners in India:
- Acupuncturists: Must provide evidence of having been Licensed by Maharashtra Council of Acupuncture as a Licensed Acupuncturist.
You represent and warrant that you meet all required licenses, certifications, and insurance for your profession and will provide accurate information regarding your credentials when requested.
Account Registration
When registering for an account, you must provide accurate and complete information, including your name, email address, professional credentials, and payment information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Billing & Renewal

Refund Policy
No refunds or credits will be provided for partial months of service or for periods when you did not use the Service. In cases of technical failure preventing access to core services for more than 48 consecutive hours, credits may be issued at our discretion.
Taxes
Subscription fees do not include taxes. You are responsible for paying all applicable taxes associated with your subscription.
HIPAA Compliance and Patient Data
Business Associate Agreement
If you are a Covered Entity under HIPAA, we serve as your Business Associate. By accepting these Terms, you also accept our Business Associate Agreement, which is incorporated by reference.
Protected Health Information
We implement physical, technical, and administrative safeguards designed to protect the confidentiality, integrity, and availability of PHI as required by HIPAA.
Your Obligations
You agree to:
- Obtain all necessary patient consents and authorizations for the use of the Service
- Only use the Service in compliance with HIPAA and other applicable healthcare regulations
- Immediately notify us of any potential or actual unauthorized use or disclosure of PHI
- Maintain appropriate security measures for your devices and network connections
Service Usage and Restrictions
Permitted Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your professional healthcare practice.
Restrictions
You may not:
- Use the Service for any illegal purpose or in violation of any laws or regulations
- Share your account credentials with others or allow multiple practitioners to use a single account
- Attempt to reverse engineer, decompile, or disassemble any portion of the Service
- Use automated systems or software to extract data from the Service
- Interfere with or disrupt the integrity or performance of the Service
- Copy, modify, or create derivative works based on the Service or its content
- Use the Service to store or transmit malicious code or inappropriate content
AI-Generated Content

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE FORM OF ACTION, IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
Term and Termination
Termination Rights
- These Terms remain in effect until terminated by either party
- You may terminate by canceling your subscription and ceasing to use the Service
- Subscription cancellations take effect at the end of the current billing period
Effect of Termination
- Your right to access and use the Service will immediately cease
- You remain liable for all fees incurred up to the date of termination
- We will provide you with an opportunity to export your data for a period of 30 days after termination
- After 30 days, we may delete your account and all associated data
General Provisions
Governing Law
These Terms are governed by the laws of the United Kingdom, without regard to its conflict of law principles.
Dispute Resolution
Any dispute arising from these Terms will be resolved through arbitration in London, United Kingdom, under the rules of the London Court of International Arbitration.
Force Majeure
We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, and Internet service interruptions.
